TOUR PACKAGE SALES AGREEMENT

CONCLUDED REMOTELY (pursuant to Articles 32–51-novies of the Tourism Code – Legislative Decree 79/2011 as amended by Legislative Decree 62/2018)

PRE-CONTRACTUAL INFORMATION

Before concluding the package travel contract, the Organizer shall provide the Traveler, via the online booking platform, with the pre-contractual information required by Article 34 of the Tourism Code, as amended by Legislative Decree 62/2018.

In particular, the Traveler is informed that:

1. Responsibility of the Organizer
The Organizer is responsible for the proper execution of all tourist services included in the package, regardless of whether these services are provided directly or through third parties (Art. 42 of the Tourism Code).

2. Emergency contact details
Before departure, emergency contact details or the Organizer's contact point will be provided (Art. 44 of the Tourism Code).

3. Transferability of the package
The Traveler may transfer the package to another person no later than 7 days before the start date, possibly incurring additional costs (Art. 38 of the Tourism Code).

4. Price revision
The price may only be changed in the cases provided for in Article 39 of the Tourism Code and never more than 20 days before departure. Increases of more than 8% entitle the Traveler to terminate the contract without penalty.

5. Changes and withdrawal before departure

The Traveler may:
or terminate the contract without penalty if an essential element of the package undergoes significant changes, or in the event of cancellation by the Organizer (Art. 41, paragraphs 1 and 5);
or withdraw at any time by paying appropriate withdrawal fees (Art. 41, paragraph 2);
or withdraw without penalty in the event of unavoidable and extraordinary circumstances (Art. 41, paragraph 4).

6. Non-conformities

In the event of a lack of conformity, the Organizer shall offer appropriate alternative solutions or, in the most serious cases, a price reduction or termination of the contract (Articles 42–43 of the Tourism Code).

7. Support

The Organizer shall provide assistance to Travelers in difficulty in accordance with the provisions of Article 45 of the Tourism Code.

8. Protection in the event of insolvency

Payments made, and if repatriation is required, are guaranteed by the fund or compulsory insurance policy (Art. 47 of the Tourism Code).

9. Booking on behalf of third parties

The Traveler who makes the online booking also acts on behalf of the other participants indicated, assuming responsibility for the accuracy of the data entered. NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS

1) Conclusion of the contract
The package tour contract is considered concluded when the Traveler confirms the order online by selecting the mandatory checkboxes and clicking on the purchase button. Following conclusion, the system immediately sends the Traveler, on a durable medium, a summary email containing a copy of the contract and the documentation required by Article 36, paragraph 8, of the Tourism Code.

2) Pre-contractual information
The Traveler declares that, prior to concluding the contract, they have received and reviewed the pre-contractual information made available online pursuant to Article 34 of the Tourism Code, as set out in Part 1 of this document.

3) Subject matter of the contract
This contract governs the provision of the tourist package selected by the Traveler during the online booking process. The characteristics of the package, the services included, the dates, the destination, and the price are shown in the order summary displayed before purchase and in the subsequent confirmation email sent on a durable medium.

4) Price and payment
The total price of the package is that indicated in the online order summary. Payment is made in full at the time of purchase, using the payment methods available on the platform.

5) Travel documentation
In accordance with Article 36, paragraph 8, of the Tourism Code, all documentation necessary to use the package (vouchers, operational information, useful contact details) is sent to the Traveler by email on a durable medium within a reasonable time before the start of the package, depending on the type of services purchased.

6) Assistance
The Organizer shall provide the Traveler with the assistance provided for in Article 45 of the Tourism Code in the event of difficulties during the execution of the package.

7) Non-conformities
The Traveler is required to report any non-conformities without undue delay, pursuant to Article 42, paragraph 2, of the Tourism Code, using the contact details indicated in the travel documentation. The Organizer shall, within the limits of the law, remedy the defect or offer suitable alternative solutions.

8) Transferability of the package
The Traveler may transfer the package travel contract to another person who meets all the conditions for using it, by giving notice on a durable medium no later than 7 days before the start of the package. The transferor and transferee are jointly and severally liable for the payment of the balance and any actual costs arising from the transfer.

9) Withdrawal, changes, and remedies
The conditions applicable in the event of changes to the package, withdrawal by the Traveler, withdrawal by the Organizer, and remedies recognized in the event of non-compliance are those provided for in Articles 39, 40, 41, 42, and 43 of the Tourism Code and already explained in the pre-contractual information.

10) Minors
If the package includes accommodation for unaccompanied minors, the Organizer shall provide, before the start of the package, the information necessary to establish direct contact with the minor or with the person responsible for them at the place of stay, in accordance with Article 34, paragraph 1, letter a), no. 8, of the Tourism Code.

11) Protection in case of insolvency
In the event of insolvency or bankruptcy of the Organizer, payments made and, if applicable, the repatriation of Travelers are guaranteed by the fund or compulsory insurance policy provided for in Article 47 of the Tourism Code. The details of the guarantee are communicated to the Traveler through the documentation sent on a durable medium.

12) Processing of personal data
The processing of the Traveler's personal data is carried out in compliance with Regulation (EU) 2016/679 (GDPR) and applicable national legislation. The complete privacy policy is made available before the order is completed via a specific link on the booking page. Any necessary consents are collected through specific, non-preselected checkboxes.

GENERAL TERMS AND CONDITIONS OF THE TOURIST PACKAGE SALES CONTRACT

1) Regulatory sources
The sale of tourist packages is governed by Articles 32–51-novies of Legislative Decree No. 79 of May 23, 2011 ("Tourism Code"), as amended by Legislative Decree No. 62/2018, as well as by the provisions of the Civil Code and any special regulations applicable to the individual tourist services included in the package.

2) Definitions
For the purposes of these general terms and conditions, the following definitions apply:
a) Organizer: the professional who combines and sells or offers for sale tourist packages.

b) Seller: the professional other than the Organizer who sells the package
prepared by the Organizer.

c) Traveler: the consumer or end customer who enters into the contract or intends to use it.

d) Package tour: the combination of at least two tourist services for the purposes of the same trip or vacation, as defined in Article 33 of the Tourism Code.

3) Responsibility of the Organizer

The Organizer is responsible for the performance of the services included in the package, regardless of whether these services are provided by third-party suppliers, pursuant to Article 42 of the Tourism Code. The Traveler must report any lack of conformity during the execution of the package without undue delay. The Organizer shall take the necessary corrective measures or, if this is not possible, shall grant price reductions or compensation in accordance with the law.

4) Price revision

Price revisions are only permitted in the cases and within the limits established by Article 39 of the Tourism Code. In the event of an increase of more than 8% of the total price, the Traveler may terminate the contract without penalty. Any price reductions entitle the Traveler to a corresponding refund.

5) Changes to the package before departure

If the Organizer has to significantly modify one or more of the main elements
of the package, or cannot satisfy a specific request
previously accepted by the Traveler, the Traveler may accept the modification or withdraw without penalty pursuant to Article 40 of the Tourism Code.

6) Withdrawal by the Traveler
The Traveler may withdraw from the contract at any time prior to the start of the package, upon payment of the appropriate and justifiable withdrawal costs, in accordance with Article 41, paragraph 2 of the Tourism Code. Withdrawal without penalty is permitted in the event of unavoidable and extraordinary circumstances that substantially affect the execution of the package or transportation to the destination.

7) Withdrawal by the Organizer

The Organizer may withdraw from the contract in the cases and under the terms established by Article 41, paragraphs 5 and 6 of the Tourism Code, guaranteeing full reimbursement of payments made by the Traveler.

8) Obligations of the Traveler

The Traveler is required to:

– comply with the rules of prudence, diligence, and applicable regulations in the destinations visited;
– follow the instructions provided by the Organizer and service providers;
– have the personal and health documents required for the trip;
– promptly communicate any special personal needs or specific requests.
The Traveler is liable for any damage caused to the Organizer or suppliers as a result of their conduct.

9) Optional insurance

Unless otherwise specified, insurance policies (travel cancellation, medical expenses, assistance, baggage) are not included in the package price. The Traveler may take them out separately, according to the conditions of the respective insurance companies.

10) Complaints

Any complaints regarding the incorrect execution of the package must be submitted without delay to the Organizer using the contact details provided in the travel documentation. The Organizer undertakes to provide a timely response in accordance with Article 42 of the Tourism Code.

11) Alternative dispute resolution (ADR)

The Organizer may provide alternative dispute resolution (ADR/ODR) tools in accordance with current legislation. In this case, the organizer will indicate the type of alternative resolution proposed and the effects that such participation entails.

12) Protection in the event of insolvency

The Organizer is covered by a mandatory guarantee, through a fund or insurance policy, which ensures the reimbursement of payments made and, if passenger transport is included, repatriation in cases of insolvency or bankruptcy, pursuant to Article 47 of the Tourism Code. The details of the guarantee are communicated to the Traveler on a durable medium.

13) Applicable law and jurisdiction

This contract is governed by Italian law. Any disputes relating to its interpretation or execution shall be settled exclusively by the court of the place of residence or domicile of the Traveler, in accordance with consumer protection legislation.

MANDATORY NOTIFICATION PURSUANT TO ARTICLE 17 OF LAW NO. 38/2006

Italian law punishes crimes relating to prostitution and child pornography with imprisonment, even if committed abroad.
